Walk two units at Mawaena Kai, the gated townhome community that has sat along Hawaii Kai Drive since 1988, and you can find the same floor plan, the same carport arrangement, the same marina-facing lanai. One unit comes with a deeded boat dock. The other does not. Nothing about the building tells you which is which. The only place that answer lives is in the title.
That split shows up again at Kalele Kai, another marina-facing complex where some units carry a dock and others don't, despite identical exposure to the water. Buyers who assume "marina front" means "comes with a boat dock" are pricing in something the listing photo can't confirm and the address alone won't guarantee.
Hawaii Kai's marina, originally known as Kuapa Pond, was declared private property by the U.S. Supreme Court in 1979 and passed from the Bernice P. Bishop Estate to the Hawaii Kai Marina Community Association in 1991. That history explains why the marina behaves like a managed private waterway rather than a public one, but it doesn't settle who gets to keep a boat where.
Hawaii treats submerged land as state property in most cases, which means a dock or pier extending into the water can require its own state lease, easement, or permit separate from the deed to the upland lot. Owning the house next to the marina does not automatically hand you the seabed under a dock, and it doesn't automatically hand you a dock at all. That right, when it exists, is a distinct piece of paper that either transfers with the sale or doesn't.
The pattern is clearest when you compare what similar-looking communities actually attach to a sale.
At Marina Palms, most units come with an individual boat dock sitting right outside the back patio, part of a design that also skips air conditioning by house rule in favor of cross ventilation across its largest four-bedroom, three-bath layouts, which run past 1,900 square feet. The dock there reads as part of the unit, not an upgrade.
The Peninsula at Hawaii Kai takes a different shape. Completed in 2006 by Stanford Carr Development across 630 units and nearly a mile of waterfront, its boat docks sit inside a shared amenity package alongside two pools, a party room, and a marina promenade, the same category as the tot park and the gazebos. A dock there is something the community offers, not something recorded against a single address.
Then there's the condo tower case. Units at Esplanade on Lunalilo Home Road have sold in the high $700,000s with marina and Diamond Head views described in the listing copy, but no private dock attached. A resident there who wants to keep a boat looks instead toward Koko Marina Center, which rents commercial slips directly to boaters on a contract basis. Those slips carry their own waitlist and have nothing to do with who owns which condo unit.
Three different buildings, three different ways of answering the same question, and none of it visible from the water.
Before comparing prices, it helps to name the three structures a dock right can take in Hawaii Kai:

The spread runs from a high-$700,000s condo with a view and no dock to a $1.25 million single-family lot with direct backyard access and none of the shared costs a condo association would otherwise absorb. Price alone doesn't sort these into a clean hierarchy of dock rights. Only the deed does.
Hawaii Kai's single-family home prices sat at a median of $1.3 million over the three months ending May 2026, down 0.42 percent from the same period a year earlier, according to Redfin's tracking of the market. Price per square foot came in at $782, down 5.8 percent year over year, and homes took an average of 88 days to sell compared with 71 days the year before.
That extra time on market matters here in a specific way. A slower spring gives a buyer room to actually pull the preliminary title report and confirm what kind of dock right, if any, comes with a marina-front listing, rather than writing an offer on the strength of a photo and a broker's description. The median price tells you what a typical Hawaii Kai home costs. It says nothing about whether that home's water access is deeded, assigned, or simply borrowed from a neighbor's goodwill until someone checks.
Marina-adjacent ownership carries its own calendar of dues and responsibilities separate from a home's HOA fee. The Hawaii Kai Marina Community Association set its 2026 annual dues at $600, payable by January 1 to Hawaiian Properties on behalf of marina lot owners.
Seawall maintenance follows a different split depending on what kind of property sits behind it. Single-family owners are responsible for the seawall directly in front of their own home. Condo associations, including those at Kuapa Isle, share the cost across their ownership. Commercial parcels handle their own frontage, which is exactly what's happening at Hawaii Kai Shopping Center, where a seawall repair project began in January 2026 and is expected to run through July.
Vessel rules add a third layer worth checking against whatever boat a buyer actually plans to keep. The marina's standard speed limit is 5 miles per hour or no wake, whichever is slower, and any boat over 21 feet must stay at slow, no-wake speeds and avoid the designated ski zones entirely. Bridge clearances inside the marina run roughly 13 to 19 feet at low tide, which can rule out a boat before a dock ever becomes the issue.
Does every home in Hawaii Kai's marina communities come with a boat dock? No. Even within the same gated complex, such as Mawaena Kai or Kalele Kai, some units carry a deeded dock and others do not.
If a condo's marina view doesn't include a dock, can I still keep a boat nearby? Some owners rent a commercial slip through Koko Marina Center, though those slips are contract-based with a waitlist and don't transfer with the unit at closing.
Who pays to fix a seawall in Hawaii Kai? It depends on the property type. Single-family owners maintain the seawall in front of their own home, condo associations share the cost for their shared frontage, and commercial centers handle their own, as seen in the repair work underway at Hawaii Kai Shopping Center from January through July 2026.
